WINDS of up to 130 kilometres per hour battered parts of the Balearics yesterday as gale force gusts swept across the region injuring four people.
Majorca’s Sierra de Tramuntana and the north east of the island was affected by the strongest winds of 130 kph, while Ibiza and Formentera, the interior of Majorca and parts of the south of the island were hit by gusts of 100 kph. Emergency crews were called out to deal with 270 incidents resulting from the bad weather and received 1800 calls requesting help and advice.

Power supplies were halted and there were numerous reports of structural damages in all regions of the Balearics.
A motorist was taken to Palma’s Son Dureta Hospital after being involved in an accident caused by the bad weather. His condition was said to be “serious.” Two people were also treated for the effects of carbon monoxide poisoning from a faulty heater used in a city home. The fourth victim was a builder who fell seven metres while working on a site in the city. The Balearics will remain on level one, yellow alert today.

The level two, orange, alert was lowered at midnight last night.
In Pollensa, trees were uprooted and blocked roads approaching the town, while many buildings in the town suffered damage.
Tiles were blown from roofs and windows were broken by the force of the winds.
Streets were deserted as people were advised to stay indoors by emergency services.
The roof was completely blown away from an empty bar in Cala Millor on Majorca’s East Coast.
A main road in Canymel was blocked by a fallen tree and a wall which was blown over by the high winds blocked a road above Andratx in the south west.
A house was badly damaged in Porto Colom and a roof was blown away from a house under construction in Puigpunyent.

Spanish Capital Gains Tax

Non-residents are liable for payment of Spanish Capital Gains Tax in Mallorca when selling their Spanish Properties.
In broad terms, the capital gains to be taxed consist of the difference between the acquisition value and the sale value of the property. The tax rate applicable to the gains is 18% (it has been considerably reduced from 35%).
The value of the sale will consist on the consideration received less any disbursements and taxes inherent to the transaction which have been paid by the vendor (Plusvalia tax, Estate Agent’s fees, Notary’s fees, etc.)

Acquisition Value for Spanish CGT purposes
The concept “Acquisition Value” is not straight forward. It takes into account the consideration appearing in the Deed of purchase plus those taxes and disbursements which are inherent to the purchase. These would include VAT/Transfer Tax/Stamp Duty/Inheritance tax, Notary’s fees, Land Registry fees, etc.
Depending on the year of acquisition, the acquisition value is also updated by applying an actualisation coefficient which is reviewed every year in the Government’s Budget.

The abatement coefficient
Those property owners who purchased before the 31st of December 1994 are entitled to apply a further “abatement coefficient”.
This is done by computing the number of years between the date of acquisition and the 31st of December 1996 and applying a reduction percentage (equivalent to 11,11%) for each year of ownership (exceeding two years of ownership). If the period of ownership is more than 10 years (from the 31st of December 1996) then the transfer is exempted from payment of Capital Gains Tax.
However from the 1st of January 2006 (when the Capital Gains are made from the 20th of January 2006) the abatement coefficient is applied prorata only up to the 20th of January 2007.

Post-completion works
Some of works in a property that are carried out after the acquisition can also be considered by the Inland Revenue as part of the value of acquisition and added to the value described. This increases the total value of the acquisition minimising the capital gains, and thus the tax liability. The value of those works is also updated by the abovementioned actualisation coefficient taking the date of finalization of the works as a tax point.
However not all the works in a property qualify as value of acquisition for the purposes of reducing the capital gain (irrespective of the fact that in reality they may have an impact in the value of the property in the open market).
The current tax legislation does not provide an exhaustive list of the works which qualify as part of acquisition value and cases are assessed on an individual basis by the tax office.
Section 54 of the Income Tax Regulations Royal Decree 1775/2004 (which refers to Resident’s Income Tax) merely establishes that “Constructions works will be considered as “acquisition of the dwelling” (for capital gains tax purposes) under the following conditions: 1 Extension of the property, when there is an increase in the habitable areas of the property by means of enclosures of outdoor areas or by any other means for year round use.2 Construction, when the taxpayer pays directly the costs of the execution of the building works or pays amounts on account to the developer, if the works are completed with a four-year period.
Conversely the following are not considered as part of the acquisition value of the dwelling
a) Conservation or repair costs as per section 12 (which refers to disbursements for the maintenance of the normal use of the assets such as paint, repair, and fixing costs, costs of replacement of elements such a heating devices, glass elements , lifts, security doors etc, cost of repair of damaged caused by break-ins, insurance premiums, etc.
b) Enhancement works
c) Acquisition of parking spaces, gardens, swimming pools and in general annexes which are not the dwelling itself when these are acquired independently from the dwelling.
The application of the above criteria is not at all clear. As an example, consultation number V1934-05 of 28 of September the taxpayer carried out the following works:
“First repair and later on, replacement of boundary walls; construction of a passage-porch lading to the garage; constructions of a path from the street to the dwelling of 30m2 approx (driveway)”; The inland Revenue authorities decided that although the works were improvements and increased the external extension of the dwelling the would not qualify as costs of acquisition for CGT purposes.
Improvements such as heating for swimming pool, landscaping irrigation system installation of gates and grills, Jacuzzi, security system electric pool covers would not qualify as value of acquisition for GCT purposes.

Property Prices to go up again in 2009

The vice-president second and minister of economy and property, Pedro Solbes, have considered that the process of adjustment of the prices of the houses in Spain can complete this year 2009.

The European Union thinks that it will take more and Solbes thinks that this is the main reason for the differences of economic forecasts given by the Spanish government and Brussels among others changes, the Solbes department waits for unemployment in 2010 of 15.7% and the European commission of 18.7%. the same happens with the gross inner product (the GIP), that Solbes hopes that in 2009 it is in -1,6% and Brussels extends its reduction until 2% the price of the house and its recovery would be behind these differences, according to Solbes. the top person in charge of the Spanish economic policy affirms that the thickness of the adjustment in the Spanish real estate sector is taking place between 2008 and 2009, with certain advance on the calculations of the European Commission, that hopes that the recovery is slower and difficult that in other countries the present commissioner of economy of the European Union, Joaquin Almunia, has explained who ” the recovery in Spain will take place with a slowness somewhat greater than the average for a reason: the adjustment in the sector of the house, that is a more difficult adjustment and takes more time than the adjustment from other economic sectors. And all the weight is known so important that española” has had the sector of the house in the economy.

Mallorca leading the ranking of the most expensive properties in Spain

Mallorca is placed again in head. By 11nth time, Balearics appears leading in the list of most expensive property; this time, this time for the most expensive houses of Spain.

According to the ranking of the real estate portal idealista.com, the four most expensive properties of the national territory are in Majorca. Idealista.com grants the fat prize to a property located in Port d´Andratx. This ” luxury estate with its six baths, five rooms, swimming pool, jacuzzi, sauna and fantastic views to the sea beat all the record with a cost of 18.5 million Euros

The second place is occupied by a property located in the Port de Pollensa, that offers more than five bedrooms, swimming pool, sauna, grounds of marble and spectacular views to the sea. The price, is half a million cheaper than the one in Puerto Andratx 17,5 million Euros.

Majorca fighting back to beat gloom as traders ‘optimistic’ for 2009 prospects

FORECASTS of impending doom and gloom sentencing Majorca to a disastrous 2009 may be a little premature.
Several local businesses this week have optimistically hinted that the forthcoming year may not be as tragic as originally thought and some traders have even predicted we may all be pleasantly surprised by what 2009 brings to Majorca.

Transport, property and tourism experts have cautiously indicated that Majorca is winning the fight to remain as the favourite destination for Britons moving abroad or choosing their favourite holiday spot.

Bill Webb, boss of Calvia’s Webb’s Removals, is preparing for a busy start to the year. His order books are full of clients wanting to move away from the financial depression gripping the UK and set up a new home in Majorca.

Customers are also taking advantage of the pound’s close parity with the single currency to purchase furniture and household goods from the UK and have them shipped back to Majorca in a bid to save cash. “I think we will all be pleasantly surprised with what the next few months have in store,” said Bill.
He forecast that the island’s economic prospects would be no worse than the previous 12 months as sterling gradually claws back lost ground against the euro. “Lots of people are heading back to Britain and purchasing large household goods, especially furniture. “It is much cheaper for households to snap up some of the bargains on offer in the UK and have them transported to Majorca,” he explained.
Bill also said that the lure of Majorca as a place in the sun was still alive with UK families – despite the exchange rate problems and other financial woes.

He claimed his company was overwhelmed with bookings to help people relocate from the UK to a new life in Majorca. “We are working 12 hours a day, most days of the week, to organise moves from the UK to Majorca. “All our lorries are completed booked for the next few weeks bringing people out to the Balearics,” said Bill.
The transport boss said he was dealing with inquiries from all kinds of clients from families to senior citizens.
